User Agreement

Terms in the current User agreement:
"Administration" is the service handling the development and support of the internet-resource Smotri.com.

"Producer" is a juridical or natural person registered on http://Smotri.com and possessing rights to produce audio-visual work (clause 13 of Russian Federation Law “Copyrights and allied rights” or the rights to reproduce audio-visual work in the Memory of Server with a purpose of its further messaging in such a way that any person can get an access to the work in interactive mode from any place and any time at his option.

"Audio-visual work" is the work composed of fixed series of interconnecting microimages (with or without an accompanied sound) aimed for visual and acoustical (if with a sound) perception by means of appropriate technical devices.


1. General conditions
1.1 Present agreement (here-in-after referred to as the “User Agreement” or “UA”) is concluded between the Administration of the Site (here-in-after referred to as the Administration) and the Producer and it regulates the partnership in respect of the usage of web-site whose link is http://Smotri.com

1.2. Administration reserves the right from time to time to change, correct or enlarge given UA. All modifications become valid at the moment of their publication on Smotri.com.

1.3. If the Producer does not agree to any clause of the modified agreement he undertakes to cease the registration on Smotri.com and leave it.


2. Object of the User Agreement
The Administration offers to the Producer its service on the terms being the object of the present User Agreement (UA). User Agreement can be changed by Administration without any special notification of the Producer by publication of the alterations made in the section “User Agreement”.


3. Description of the service
The Administration offers to the Producer the opportunity to upload, store and view video-content. The Producer realizes and agrees to the fact that this service is provided to him “as it is” and that the Administration does not bear responsibility for any delays, failures or improper operation of the service as well as for its discrepancy with the aims of the Producer.


4. Producer’s obligations as regards the registration on site
4.1. The Producer must go through the registration procedure:
a) to fill in the Registration Card, to choose a login and a password for the further entering the system of Smotri.com;
b) to read and realize the User Agreement;

4.2. All actions made by the visitor who logged in with a login and a password of the Producer are considered to be the actions of the Producer. The Producer bears full responsibility for all actions made by the person authorized on behalf of the Producer.


5. Cessation (deletion, blocking) of the registration

The Administration has the right to break the partnership with the Producer in case of violation of the UA by the Producer. Administration reserves the right to interrupt or to stop providing a service without explanation of reasons.


6. Rights, guarantees and the obligations of the Producer
6.1. The Producer guarantees that he is the right-holder of the producer of the audio-visual work uploaded to the pages of Smotri.com (clause 13 of the Russian Federation Law “Copyrights and allied rights”) or the owner of rights for reproduction of audio-visual work in the Memory of Server with a purpose of its further messaging in such a way that any person can get an access to the work in interactive mode from any place and any time at his option.

6.2. The Producer uploading audio-visual works on the pages of Smotri.com allows the Administration to effect the reproduction of audio-visual work in the Memory of Server with a purpose of its further messaging in such a way that any person can get an access to the work in interactive mode from any place and any time at his option.

6.3. The Producer agrees to fact that he bears full responsibility for all video-materials (audio-visual works) which he sends, receives, transfers or makes accessible by means of the service Smotri.com. In case of Administration’s claims arisen from the violation of the existing legislation, The Producer undertakes to settle all claims at his expense.

6.4. The Producer agrees that the Administration can give any information about the Producer at the request of the law-enforcement bodies.

6.5. The Producer agrees not to use the Smotri.com for:
a. delivery, transfer or any other kind of publication of materials which are illegal, injurious, threatening, offending morality, violating copyrights, propagandizing hatred and/or
racial, ethnic, sexual, social discrimination of people;
b. infringements of rights if minor persons and/or doing harm to them in any form;
c. infringements of rights of minority;
d. representation of oneself as the other person or as the representative of an organization and/or a community without sufficient rights including the representation of oneself as the employees of Smotri.com, owner of Smotri.com and misleading about features and characteristics of any subjects or objects;
e. delivery, transfer or any other kind of publication of materials which must not be accessible according to law or any contractual relations;
f. delivery, transfer or any other kind of publication of materials which infringe any patent, trade mark, commercial secret, copyright or other property rights and/or copyrights and allied rights of the third party;
g. delivery, transfer or any other kind of publication of materials containing advertising information without special consent, spam, “schemes-pyramids’, etc.;
h. delivery, transfer or any other kind of publication of any serial numbers to the commercial products or the programs for their generation, logins, passwords and other means for obtaining illegal access to the payable resource in Internet or placement of links to the information above;
i. infringements of the existing rules of legislation;
j. uncoordinated delivery, transfer of advertising, commercial or propaganda information;
k. delivery or transfer of the messages concerning somebody and containing rude and abusive expressions or sentences;
l. delivery or transfer of porno-content.


7. Non-commercial application
The Producer agrees not to use any part of the service Smotri.com for commercial purpose.


8. Property rights of Smotri.com
8.1. Unless otherwise has been defined in the additional agreement between the Producer and the Administration, all claims, requests, enquiries, correspondence addressed to the Administration should be submitted in a form of a feedback which can be taken on the page http://Smotri.com/help/support.

8.2. While registering on the site Smotri.com the Producer agrees to the terms of the present UA (clause 438 of Russian Federation Civil Code).

8.3. Parties agree that all possible disputes arisen in connection with the present UA will be settled in accordance with the existing legislation of Russian Federation.++ User Agreement

6.3. The Producer agrees to fact that he bears full responsibility for all video-materials (audio-visual works) which he sends, receives, transfers or makes accessible by means of the service Smotri.com. In case of Administration’s claims arisen from the violation of the existing legislation, The Producer undertakes to settle all claims at his expense.

6.4. The Producer agrees that the Administration can give any information about the Producer at the request of the law-enforcement bodies.

6.5. The Producer agrees not to use the Smotri.com for:
